5SOS Lawsuit: #5SOSIsGoingToJail

Australian rock group, 5 Seconds of Summer (5SOS), are currently facing a lawsuit brought on by White Shadows, LLC. David Henderson, David Toth, and Peter Ferencz have accused the band of stealing one of their songs.

Bloomberg Law notes that a complaint was filed against the group on July 15, 2019 in the Northern District of Texas. The case is being pursued by White Shadows, LLC. The musicians claim that “Youngblood” uses identical melodic phrases to their song “White Shadows.” Here’s what you need to know about the 5SOS lawsuit:

“White Shadows” was released in 2016 by David Henderson. The official music video has over 172,800 views on YouTube. People have since been watching the video and leaving comments after the news of the lawsuit broke. Fans are sharing their opinions in the comment section, but everything seems to be pretty divided.

Whether you believe the songs sound the same or they don’t, there’s no denying that this is a serious accusation. Legal representatives for White Shadows, LLC claim that the similarities between the two songs is “so striking it could not be the result of mere coincidence.”

“Youngblood” was released by 5 Seconds of Summer in 2018, the title track of their latest album. Their fans took to the comment section under the official music video to defend their boys. One comment reads, “I will stand by 5SOS no matter what happens.” While this was the case for most fans, other fans found it more suitable to poke fun at the boys.

So… Are 5SOS going to jail?

No! (At least not yet?) While the case is yet to reach a verdict and it will be an agonizingly long process, it won’t be a matter of the members going to jail. I guess one can dream if you have a weird kink for boys in orange, but the closest you’ll get to 5SOS in cuffs is Luke in the ‘Easier‘ music video.

Fans on Twitter began trending “#5SOSIsGoingToJailParty” along with a frenzy of tweets cracking jokes.

Drummer, Ashton Irwin, addressed the lawsuit publicly on Twitter. He writes,

Only time will tell what’s going to happen during the case. Here at MDRN MAG, we’ll keep you updated. Check back for any announcements as we wait in anticipation to see if 5SOS are going to jail or not!
